Distance Sales Contract

Contract for sales of Companion license/token codes.

Article 1 — Parties

This contract covers sales made directly by İçerik Yöneticisi (WhatsApp / email, in Turkish Lira). If you buy Companion through Google Play, Google is the seller and Google Play's own terms apply.

BUYER: the person who provides their name and contact details over WhatsApp or email during the purchase process and, if they request an invoice, their invoicing details.

Article 2 — Subject

The subject of this contract is to set out the rights and obligations of the parties, under Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, in relation to the sale and delivery of a digital license/token code for the Companion mobile app, purchased by the BUYER from the SELLER using means of distance communication (WhatsApp and email).

Article 3 — Product, Price and Payment

  • Product: Companion Pro license/token code (1, 3, 6 or 12 months).
  • Price: the total amount including VAT published at https://icerikyoneticisi.com/plans/refakatci and given to the BUYER in writing in the WhatsApp conversation before payment.
  • Payment: made by the BUYER according to the payment details given in writing by the SELLER before payment. There is no automated payment system on the site.
  • Delivery: the code is delivered by WhatsApp or email within 24 hours at the latest after the SELLER has confirmed the payment. There is no delivery fee.

Article 4 — Pre-Information and Formation of the Contract

  • Before payment, the SELLER sends the BUYER the Pre-Information Form, this contract and the Cancellation and Refund Policy, together with the package to be purchased and the total price including VAT, in writing over WhatsApp.
  • After reviewing this information, the BUYER confirms their intention to purchase to the SELLER in writing.
  • The contract is formed when the BUYER gives that written confirmation and makes the payment.
  • Following formation of the contract, the SELLER sends this contract and the pre-information to the BUYER by WhatsApp or email in a form the BUYER can keep.

Article 5 — Obligations of the Parties

  • The SELLER is obliged to deliver a working code and to provide support within a reasonable time for problems related to the code.
  • The BUYER is obliged to use the code for their own use and not to sell or share it with third parties.
  • If misuse of the code is detected, the SELLER may cancel it.

Article 6 — Right of Withdrawal and Voluntary Refund

The provisions of the Distance Contracts Regulation apply to the statutory right of withdrawal. Article 15(1)(ğ) of the Regulation lists contracts for intangible goods delivered instantly to the consumer among the exceptions to the right of withdrawal.

Independently of this, the SELLER provides voluntary refunds under the conditions set out in the Cancellation and Refund Policy. A voluntary refund does not replace the statutory right of withdrawal and does not limit the BUYER's statutory rights.

Article 7 — Invoice

The SELLER issues the invoice for the sale in accordance with the tax legislation in force and sends it to the BUYER.

Article 8 — Disputes

For disputes arising from this contract, the Consumer Arbitration Committees have jurisdiction within the monetary limits announced by the Turkish Ministry of Trade, and the Consumer Courts above those limits.

Article 9 — Entry into Force

This contract enters into force at the moment it is formed as described in Article 4.
